主体间性视阈下高校教育纠纷解决机制的重构

摘    要:高校教育纠纷频繁发生,对教育事业的健康发展产生了消极影响。现行的纠纷解决机制存在着明显的问题。从主体间性的视角分析,最深层次的原因在于现行制度设计没有真正从尊重教育纠纷相对人的主体地位这一立场出发,切实保障他们的程序权利,通过对话与沟通解决纠纷。因此,需要本着尊重人的主体地位的精神重构我国的高校教育纠纷解决机制。

Abstract:Disputes have been occurring frequently in higher education, which has made a negative impact on the healthy development of the educational endeavors. The current dispute settlement mechanism has obvious problems. Analyzing from the perspective of inter-subjectivity, we find that the deepest reason lies in the current institution setup which does not really start from respecting the dominant position of people relative to the education disputes, protecting people's procedural rights and resolving the dispute through dialogue and communication. Therefore, we should reconstruct our education dispute settlement mechanism based on the spirit of respecting the dominant position of people.
