| 摘 要： | 儒家"重民"思想并非为民请命,而是为了调和阶级矛盾,维护统治阶级利益。法家的法治不过是统治者镇压人民的工具。传统的"德治"和"法治"都是"人治",与现代"法治"是两码事。现代民主观念注重个人权利与自由,倡导个性解放和人的全面发展,并用法治来保护人民当家作主的权利。建设社会主义政治文明必须"依法治国"、"以德治国"。

| Abstract: | Instead of caring for people, the Confucianists' thoughts of"paying high attention to people"are to compromise the class contradictions and safeguard the interests of ruling class. The so-called ruling-by-law of the Legalists is the tool used by the rulers to suppress the people .The traditional rule of virtue and ruling by law are ruled by man in nature. Modern democracy lays stress on individual rights and freedom, initiates the freedom of individual character and personal overall development, and protects the people's rights to be master ruling by law. To build our social political civilization, we should implement the general plan of managing state affairs by combining"rule of virtue" with"ruling by law". |
