农村土地承包经营权抵押若干问题探讨

土地承包经营权抵押已经在全国很多地区开展试点，但是在实践中存在诸多障碍阻碍了其发展。目前，土地承包经营权抵押中既存在政策层面与立法层面态度不一致的问题，也存在政府某些领域过度干涉和某些领域不作为的矛盾。为更好地开展土地承包经营权抵押，一方面要从立法层面对不合理的规定加以修改或废除，并制定新法，在抵押关系当事人、标的物、实现规则、生效规则等方面明确规定；另一方面，政府应当提供更好的服务，为土地承包经营权抵押提供基础服务。

Several Issues about Mortgage of Land Contract Management Right

Mortgage of land contract management right has been implemented in many pilot areas in China, but the practice encounters many obstacles which restrict its further development, including the disagreement between policy and legislation, and the contradiction between excessive interference and nonfeasance of government administration. Therefore, on the one hand it is necessary to amend or repeal some improper regulations and formulate new laws to give clear definitions to mortgage parties, subject matters, realization rules and validation rules, and on the other hand government should provide with better and more basic services for the mortgage.
