环境资源保护法视角下野生食用菌资源的保护与开发法律问题及建议

在我国野生食用菌资源保护与开发过程中,部分地区野生食用菌资源乱采乱挖现象严重,缺乏对野生食用菌资源保护与可持续利用的重视。从环境资源保护法的角度来看,当前我国针对野生食用菌资源保护的法律、法规可操作性不强,部分地区执法依然空缺,村民对于野生食用菌的法律保护意识匮乏。因此,地方政府建立专门保护野生食用菌资源的地方规范性文件,强化执法,加大执法投入,加强对产地村民关于野生食用菌保护的意识法律宣传。

Protection and Development of Wild Edible Fungi Resource from the Perspective of Environmental Resource Protection Law

At present,in the process of protection and development of wild edible fungi resources in China,wild edible fungi resources in some areas are seriously mined and dug in disorder,which lack of attention to the protection and sustainable utilization of wild edible fungi resources.From the perspective of environmental protection law,the current laws and regulations for the protection of wild edible fungi resources in China are not strong in operability,some areas are still lack of law enforcement,and villagers lack of awareness of legal protection of wild edible fungi.Therefore,the local government should establish the local normative documents to protect the wild edible fungi resources,strengthen the law enforcement,increase the investment in law enforcement,and strengthen the legal publicity of the villagers'awareness of wild edible fungi protection.
