我国《城乡规划法》的不足及完善对策——基于我国城市建筑“短命”现象的反思

基于当前我国城市建筑"短命"现象与城市规划存在的随意性与权力滥用等问题以及城市规划存在的问题与我国《城乡规划法》的功能性缺失和制度性缺陷之间关系的研究,提出我国《城乡规划法》应注重控制城乡规划主管部门行政权的行使并严格城市规划的修改制度、明确城市规划应考虑产权保护、限制规划管理部门的自由裁量权等对策与建议,从而遏制城市建筑"短命"现象、规范城市规划行为,为完善我国《城乡规划法》提供参考。

Deficiency and Improvement Countermeasures of Urban and Rural Planning Law

In terms of the short-lived building,the problems of randomness and power abuse in city planning,as well as the relations between the functional deficiencies and institutional flaws of China Urban and Rural Planning Law,it was proposed to regulate the administrative power execution of urban and rural planning departments,work out strict rules of revising city planning,take into account the property right protection and control the discretion of planning departments,so as to curb the short life of city buildings,regulate city planning and provide references for China Urban and Rural Planning Law.
