仲裁第三人制度的设立

随着社会的发展,民商事活动越来越频繁、复杂,尤其是仲裁中涉及第三人的案件越来越多。然而,由于我国关于仲裁第三人制度在仲裁法中没有明确规定,学界对我国立法是否应设立仲裁第三人制度也有很大分歧,因而在仲裁实际中出现了不少问题。设立仲裁第三人制度,要严格控制仲裁第三人范围,明确其权限,由法院实施监督。
