| 摘 要： | 探讨在我国以专门立法的方式保护地理标志的必要性，分析了在地理标志保护中尚待解决的若干问题，主要包括统一地理标志的注册，避免多重保护之间的冲突，合理解决现存的地理标志与普通商标的冲突。增加地理标志的事后确权。规范地理标志的组成，淡化政府在地理标志保护区域划分方面的干预，加强对地理标志使用的监管、严格侵权法律责任等。

| Abstract: | The necessity to protect geographical indications by legislation in China is discussed, and the problems in geographical indications protection are analyzed, which includes standardization of geographical indications registrations, avoidance of the conflicts between multiple protections, solutions of the conflicts between geographical indications and brands, adding the after-the-fact right recognizing of geographical indications, standardizing the structure of geographical indications, reducing government intervention in dividing zones for geographical indications protection, strengthening the inspection of geographical indications use, and being strict in legal responsibility against tort. |
