| 摘 要： | 从新旧农村合作医疗制度的历史出发，阐述了新型农村合作医疗制度的立法可行性与必要性，重点分析了〈新型农村合作医疗法）的三大关键性的立法障碍，并于观点林立的分歧中阐明了本文作出的立法选择，最终对立法进程与立法体系的构建提出了建议。

| Abstract: | Based on the history of the old-type and new-type rural cooperation medical service, this paper discusses the necessity and feasibility of legislation, then focuses on three pivotal obstacles in the lawmaking, and concludes the choice among different viewpoints and branchings. It finally makes suggestions on the legislation plan and the whole system. |
