摘    要:分析了当下我国市场经济体制下的食品安全现状,认为其已成为危及人体健康的重要因素,主要表现在:一方面,针对性的食品安全监管法律法规尚不健全,法制监管体系内部机构设置不完善;另一方面,法制监管执法队伍素质不高,执法人员自律意识不强,人情执法、利益执法现象难以根除,使得食品安全状况难以保障。对此,建议加大食品安全法律制度建设,形成立体化全程式监管机制;优化监管机构职位设置,实行分工明确、责任到人制度;全面加强执法队伍的作风建设与执政能力建设,进而构建高效的食品安全法制监管模式。

Abstract:The present situation of food safety in the market economy system of our country was analyzed,which was thought to become an important factor endangering human health.It is mainly manifested in two aspects: on the one hand,targeted food safety regulatory laws and regulations is not perfect,the internal mechanism of legal supervision system is not perfect;on the other hand,the legal supervision of law enforcement personnel quality is not high,the law enforcement personnel self-discipline consciousness is not strong,human law enforcement and law enforcement interests phenomenon is difficult to eradicate,which result in difficult to protect food safety situation.In this regard,it is recommended to increase the legal system of food safety,build a three-dimensional full program supervision mechanism;optimize the position of regulatory agencies,implement the system of clear division of labour with individual responsibility;strengthen the construction of style and ruling ability of law enforcement team,then construct efficient food safety legal supervision mode.
