生态法的三维模式讨论

生态文明是继农业文明、工业文明之后的人类文明形态,生态法是对生态文明建设的制度回应。但生态法并不是单一的法律规范集成,而是有其自身的逻辑结构,本文提出,生态法在三维模式基础上形成的,所谓三维模式是由生态伦理、生态技术和生态法律制度相互联系、相互作用所组成的一种理想的模式,该模式生态法建立的基础、原动力、未来发展的方向指引,乃至在生态领域的法治运行的解释路径。同时,在这种模式下生态伦理是生态技术和生态法律制度形成的伦理基础,生态技术则是将生态伦理和生态法律制度应用到社会生态保护实践中的重要方法和手段,生态法律制度则是对生态伦理的不断演进以及生态技术生产和实施的保障,三者共同组成生态法立体型结构模式。本文从生态法三维模式的形成和发展、三维之间的关系以及其对生态法的作用等三个方面简要分析和讨论了生态法三维模式的重要作用。但是由于生态法在具体内容的模糊性,以及在研究的深入细致的缺乏,目前,我国的生态法的三维模式在现阶段还处于一个理想的状态。无论如何,国家加强生态伦理教育、创新和发展生态技术,完善生态法律制度,都是生态法走向完善的必要之举。

Discussion of the Three-dimensional Mode of Ecological Law

Ecological civilization comes after our agriculture civilization and industrial civilization. Ecological law is the response of ecological civilization system. However,ecological law is not one-fold integration of legal norm. It has its own logical pattern. This article proposed that ecological law forms on the base of three-dimensional mode. This mode is the interrelation and interaction of ecological ethic,technology and law system,which is an ideal mode. This mode is the foundation base,motive power,future development and direction of ecological law,or even the explanation way for government by law in ecological field. Meantime,ecological ethic is the ethical basis of ecological technology and law system under this mode. Ecological technology is the important means and methods to put ecological ethic and law system into use in the practice of ecological protection. Ecological law is the guarantee for ecological ethic’s evolution and ecological technology’s production. They all together form a three-dimensional mode for ecological law. This article will discuss and analysis the important role of three-dimensional mode of ecological law by three aspects,which include its formation and development,interrelation and effect. Since the fuzzification of ecological law’s content,and lack of lucubration,the three-dimensional mode if ecological law is still under an ideal condition in our country. On all accounts,to enhance the education of ecological ethic,the creation and development of ecological technology and the evolution of ecological law system is indispensable way for consummating ecological law.
