中国生态资源保护法的基本理论构建

对生态资源保护法的概念予以界定，阐述了生态资源保护法的特征、本质、作用和构建生态资源保护法的基本原则。认为：生态资源保护法除具有一般法律应有的权威性、规范性、强制性的特点外，其还具有涉及的范围广泛性，经济、技术和法律的结合性，社会性，共同性等特点；生态资源保护法是社会法、以社会利益为本位的法、以持续发展为价值的法；生态资源保护法是实施可持续发展战略的有利武器、是现行环境法和资源法的必要补充；生态资源保护法的建构应以从保护到发展、从单纯经济开发到全面生态建设为原则，以尊重自然规律进行综合治理为原则，以全面规划、合理利用生态资源为原则，以国家宏观调控为原则。

Theory Construction of Conservation Law for China Ecological Resources

This paper defines the ecological resources protection law, which illustrates its feature & essence, function and basic construction principle. The author considered that the ecological resources protection law not only has some features of a common law, such as authority, standard, compulsory, but also has other features, such as extensive scope, combination of economy and technology, society, common, etc. The ecological resources protection law is a social law, whose basic purpose meets social benefit to attain sustained development, and it is a good weapon to implement sustained development strategy. It is a necessary supplement to perfect the environment law and the resources law of nowadays. Construction of the ecological resources protection law must obey these principle: from protection to developing, from pure economic exploiting to top ecological construction, following natural law to integrated management, top program and rational use of ecological resources, government centralize guidance.
