摘    要:农村土地征用是国家强制取得农民集体土地所有权的行为。本文首先分析了农村土地征用中存在的问题,包括征地补偿标准不明确不统一、不能解决失地农民长期的生活保障、对“为公共利益需要”而征收土地的规定不明确以及征地纠纷缺少法律救济等问题。提出了完善农村土地征用制度的法律对策:包括提高征地补偿标准,统一计算方法,完善土地征用相关法规,明确界定“公共利益”范围,建立失地农民社会保障体系,解决失地农民的养老问题,建立完善的征地纠纷法律救济体系等。

Abstract:Expropriating the land of rural is the act for the government to use the rural land by law.In this essay,the defects of rural land expropriating have been analysed first,as the standard for compen- sation is not defined and consistent,the basic living level of the land losers can't be safeguarded,the laws of expropriating lands for public interests are not clearly regulated,and there aren't enough legis- lative regulations to solve the quarrels in expropriating lands.In this paper,the legislative solutions to improve the rural expropriating land institutions has been put forward,such as enhancing the standard for compensation,unifying conculation methods,perfecting legislative regulation,critering the scope of public interests,establishing the social safeguard system for the land losers to safeguard the land los- er' living out their lives,and building the legislative system for solving problems in the course of ex- propriating lands.
