| 摘 要： | 包庇毒品犯罪分子罪应包括帮助毒品犯罪分子毁灭、伪造罪证的行为方式,对于本罪对象规定应从四个方面把握;犯走私、贩卖、运输、制造毒品罪的人能够成为本罪主体,对于本罪中的明知应从明知的时间、内容、程度三方面理解;对于本罪第二款的规定的理解关键是理解本款规定的"掩护"的含义以及对缉毒人员或者其他国家机关工作人员利用职务上的便利条件实施掩护、包庇行为的定性问题。
