对渔民养殖用海征收海域使用金合法性的探讨

国务院关于渔民养殖用海征收海域使用金的办法至今尚未出台,以致一些地方的渔民产生"一项不该收取的费用何来减免"的疑惑,并以此为据拒缴海域使用金。通过对渔民养殖用海征收海域使用金合法性的分析,应明确两个认识:第一,渔民养殖用海应缴纳海域使用金,这是符合我国海域有偿使用制度的;第二,部分地方性法规和地方政府规章通过对《海域使用管理法》第三十六条作出具体规定来明确渔民海域使用金的减免,有利于保护渔民合法权益。

Study on Whether Fisherfolk Should Pay for the Charge of Using Sea Area

As the State Department have not approved any legislation for the collection of the charge of fisher-folk using sea area, most of the fisherfolk refuse to pay for the charge of using sea area. According to our current law, there are two key points in this issue. Firstly, fisherfolk should pay for using sea area which is in accord with our legal system of using sea area with compensation. Secondly, some local legislation which derates the charge of fisherfolk using sea area has benefits for fisherfolk in the face of our current situation.
