我国农村宅基地使用权流转合理性研究

文章从实现农村宅基地使用权公平与提高土地利用率,确保村民、集体和政府三者共同利益,统筹城乡协调发展,以及宅基地使用权流转在社会主义新农村建设中筹集资金的作用等角度出发,分析了农村宅基地使用权流转的合理性,认为在充分尊重农民自愿原则的基础上,分区域、有差别地推进我国农村闲置宅基地使用权的流转,有利于解决当前农村宅基地利用率低、资产流失和新农村建设资金筹集难等问题。

A Research on the Rationality of Rural Residential Land Use Right Circulation

From the point of view of realizing fairness and efficiency of rural residential land and ensuring the villagers,the collective and the government common interests,development of urban and rural coordinated and the role of fund-raising through the transfer of land use right in the construction of new socialist countryside,the rationality of circulation of the use right of the rural residential land was analyzed in the paper.It was considered that,on basis of full respect for the farmers’ free will,it was reasonable to solve the problems of using rural residential land inefficiently at present,assets lost and fund-raising difficult for construction of new countryside,and promote the circulation of use right of Chinese rural residential land by regions and differences.
