| 摘 要： | 文章分析了减缓观赏植物品种权申请授权速度的原因,如品种暂定名称不符合规定、新颖性异议调查取证难、近似品种选择难度大,以及申请人不能按期送交用于测试的繁殖材料等,并针对产生问题的原因提出了申请人及时答复审查意见、审批机关规定送交繁殖材料的最后期限、大力改善测试条件和加强测试技术合作等加快观赏植物品种权申请授权速度的途径,以期促进我国观赏植物的育种创新。

| Abstract: | At present,the problems of proposed denomination,novelty,similar varieties,plant material and so on are influencing on granting speed of application of ornamental plants varieties.Above those,some improving measures were given in the paper,such as applicants should reply to opinions of examination within designated term,the examining and approving authority may make regulations of testing for plant material submitted by applicants,improve conditions of testing,strengthen cooperation of testing technologies,and so on.These will accelerate the granting speed of the new varieties right and promote breeding innovation of ornamental plants in our country. |
