法官自由裁量权的伦理规制研究

法官自由裁量权的行使充分体现了道德判断与伦理选择，因此有必要从伦理的视角对其进行考量和审视。法官的自由裁量权具有价值取向性、伦理自主性、主观能动性、自由有限性等伦理属性，以相对现实主义、司法能动主义和实现个案正义为其存在的伦理依据，其运行应当遵循彰显司法正义、彰显司法良知、讲求司法公信、符合公序良俗等伦理限度。
