法官自由裁量权规制刍议——以量刑规范化改革为视角

法官自由裁量权长期以来都是社会关注的热点,英美法系和大陆法系国家对于法官自由裁量权都有相当的重视,加之我国目前法官自由裁量权存在的问题,使得有对其进行规制的必要性。在我国着力推进量刑规范化改革的背景下,法官的自由裁量权应当主动迎合改革的步伐,从提高自身素质、改善立法境况以及规范裁判文书制作等方面对法官自由裁量权进行规制,从而实现量刑公正。

Judicial discretion has long been the focus of society.Anglo-American law system and continental law system countries all pay full attention to the judicial discretion.It is necessary to limit the judicial discretion because of its current problems.In the background of promoting standardization of sentencing,the judicial discretion should cater the progress of the sentencing standardization.From improving their own quality,improving legislation circumstances and regulating the referee document making to limit judicial discretion,so as to realize the fair sentencing.
