| 摘 要： | 海峡两岸著作权利限制制度，有很多相似性又各有特色。《中华人民共和国著作权法修订草案(送审稿）(2014)》与台湾地区现行“著作权法”在著作权权利限制制度方面存在诸多异同。著作权权利限制制度是权利平衡的制衡器，国务院颁布的草案在这个领域修改不多，对网络合理使用回应不足，未能和国际条约保持同步，因此草案仍有改进的空间。

| Abstract: | There are many similarities and differences in copyright restriction systems between both sides of the Taiwan Strait, which can be easily found in Amendment of Copyright Law of the People''s Republic of China (2014 Draft) and current Copyright Law of Taiwan. Copyright restriction system is an important tool to balance rights, but most relevant articles in the amendment enacted by the State Council were not improved, and it failed to make a quick response to the reasonable use of copyright on the Internet and keep pace with international treaties. So there is space for further improvement. |
