论计算机软件修改的著作权法规制

随着信息技术的飞速发展,有关于计算机软件修改的问题也日渐变得重要起来。我国《计算机软件保护条例》明确规定了软件修改权。通过对我国计算机软件修改的立法分析,指出存在的问题,借鉴欧美发达国家相关制度,应当借助著作权法第三次修订,将软件修改行为通过著作权法上的作品改编权予以规制。

Research on the Copyright Regulation of Computer Software Modification

With the development of information technology, the modification of computer software has become more and more important. The Regulations on the Protection of Computer Software has clearly defined the right to modify the software. Based on the legislation analysis of China’s computer software modification, this paper pointed out the existing problems, and introduced the related legislation in other countries, and suggested that it should regulate the computer software modification behaviors by confirming the right of adaptation in the third amendment of Copyright Regulation.
