| 摘 要： | “婚内强奸”算不算犯罪,理论界已经存在众多争议。主要有三种观点：全盘否定说,全盘肯定说以及折中说。然而在现实生活中,它依然侵害着女性的合法权益,危及家庭的稳定和睦。笔者认为婚内强奸构成犯罪。为了切实的保护妇女的合法权益,严惩这种恶劣的行为,我国立法对其做出明文规定为强奸罪将成为一种必然。

| Abstract: | Whether marital rape is a crime is a problem debated extensively. Three viewpoints exist, i.e. affirmative, negative and neutral. In our daily life, marital rape violates the harmony of the family and women＇s legal right. The author holds that marital rape is a crime. In order to provide practical protection of women＇s legitimate rights and interests and punish this bad behavior, it is necessary to stipulate by legislation that marital rape is a crime. |
