| 摘 要： | 随着2012年刑事和解制度以一种特别程序在新刑诉法中的确立,无论是在理论界还是实务界都受到广泛的关注和欢迎。但是刑诉法只有三个条文对此作出规定,而且适用面较窄,难以迎合现实社会的需求。通过对国外相关制度以及国内现状的比较,结合相关理论,以一种实证立场进行分析,笔者认为可以进一步扩大适用刑事和解制度。

| Abstract: | Criminal reconciliation system has been widely concerned and welcome both in the theoretical circle and real world,when it was established in the Criminal Procedure Law with a special procedure in 2012. But the Criminal Procedure Law regulates it only with three provisions and its scope is very narrow so that it is difficult to meet the needs of reality. Through the comparative analysis of foreign related system and the domestic status quo,combined with related theories,I think we can expand the application of criminal reconciliation when we analyze it in a positive position. |
