| 摘 要： | 市场体制是影响形成食用菌菌种保藏机构公正地位的主导力量,而依靠法治机制才是实现菌种保藏机构社会公正化的根本保障。因此,加强我国食用菌菌种管理和产权保护应该置于市场经济的条件下研究和考虑,更需要相应法律规章的制衡,而不应过高地寄期望予保藏机构的授权地位和形式。

| Abstract: | Market mechanism plays the main role in establishing the spawn preservation organization of edible fungi(CCOEF) with equitable social status,and the rule of law is the basic guarantee for the justice of the spawn preservation organization.Hereby,it is necessary to study how to improve management and intellectual property protection of edible fungi spawn under market economy conditions and to enforce the law rather than pay too much attention to status and forms of the CCOEF authorized by the government. |
