食用菌菌种监管办法的安全法律责任体系的重构

摘    要:针对食用菌菌种在管理工作中存在的缺乏知识产权保护意识、品种权受到侵害、产业销售混乱以及标准体系不健全等问题,重构食用菌产业安全法律责任体系。通过构建食用菌菌种企业行业自律体系,增强食用菌企业的菌种安全责任观念,提高企业生产经营食用菌的安全保障性;通过完善责任分配以及公开制度,监督问责,实现政治责任法律化;整合与规范食用菌菌种安全规制机构,加大食用菌菌种安全规制的跨域合作,实现沟通交流无阻碍;通过建立完整的"追溯制度"强化全程监管机制,应对突发事件产生时,快速解决安全问题。

Abstract:In view of the problems in the management of edible fungi, such as the lack of intellectual property protection awareness, the infringement of variety rights, the confusion of industrial sales and the imperfect standard system, the safety legal liability system of edible fungi industry was reconstructed. Through the construction of the industry self-discipline system of edible fungi enterprises, the concept of safety responsibility of edible fungi enterprises was strengthened, and the safety assurance of edible fungi production and management was improved. To legalize political responsibility by improving the distribution of responsibilities and the system of openness, and by supervising and holding people accountable. Integrate and standardize the regulations on the safety of edible fungi, increase the cross-domain cooperation of the regulations on the safety of edible fungi, and realize the communication without obstacles. Through the establishment of a complete traceability system to strengthen the whole process of supervision mechanism, to deal with emergencies, quickly solve the security problems.
