知识产权视角下新型食用菌菌种保护途径探讨

摘    要:在食用菌菌种法律法规保护体系下,通过分析新型食用菌菌种知识产权保护类型,得到知识产权保护类型为商标权保护、专利权保护、品种权保护以及商业秘密保护,以此为基础,提出分别保护新型食用菌菌种育种环节、生产环节、加工环节与流通环节的知识产权,实现了知识产权视角下新型食用菌菌种的保护。与现有的新型食用菌菌种保护途径相比,知识产权视角下新型食用菌菌种保护途径极大地增加了保护类型,充分说明知识产权视角下新型食用菌菌种保护途径具备更好的保护效果。

Abstract:Under the protection system of edible fungus strain laws and regulations, based on the analysis of the types of intellectual property protection of new edible fungus strains, the types of intellectual property protection are trademark right protection, patent right protection, variety right protection and trade secret protection. Compared with the existing protection methods of new-type edible fungi, the proposed protection methods of new-type edible fungi greatly increase the protection type, which fully shows that the proposed protection methods of new-type edible fungi from the perspective of intellectual property have better protection effect.
