剖析一起违法经营种蛋的案例

Analysis on a Case Concerning Illegal Operation with Hatching Eggs

Mr. Zeng was administratively sanctioned by the law-enforcement staff from Ningdu County Animal Health Supervision Institute,Jiangxi Province due to his operation with hatching eggs,which shall be legally inspected but not. Mr. Zeng refused to comply and appealed to the Ningdu County People’s Court and Ganzhow City Intermediate People’s Court,claiming that his lot of hatching eggs does not belong to the quarantine object as speciifed in The Law on Animal Disease Prevention,the law-enforcement staff have not shown the ofifcial veterinarian certiifcates,so they are not ofifcial veterinarians and are not qualiifed to implement the animal and animal product quarantine and inspection. After hearing,the court of second instance considered that the administrative sanction made by Ningdu County Animal Health Supervision Institute is based on the clear facts,enough evidence,proper procedures and the accurate applicable laws,and ifnally decided that Mr. Zeng loses the law-suite. Reason for Mr. Zeng’s frequent appeals was his misunderstanding of the related laws and regulations.
