| 摘 要： | 中国宅基地使用权主要是依靠《土地管理法》和《物权法》进行保护的,但并没有形成完整的法律体系,法律保护明显不足,造成与实际情况的差异较大.通过对中国农村宅基地使用权设立、流转、消灭以及监督制度的深入分析,建议应完善宅基地使用权的立法规定,规范宅基地使用权的初始取得,建立宅基地使用权的登记制度,促成宅基地使用权的自由流转,建立健全宅基地使用权的监管制度,以更好地维护和保障农民的宅基地权益.

| Abstract: | Chinese homestead right of use was mainly protected depends upon land management law and property law,but had not formed the complete legal system and legal protection was obvious insufficient,which resulting in large differences with the actual situation.Through the establishment,circulation,elimination as well as in-depth analysis of the supervision systems to the homestead right of use,the opinion that the government should consummate the legislation stipulation of the homestead right of use,standardize initial acquisition of homestead right of use,establish the registration system,facilitate the free circulation,strengthen the supervisory system,and safeguard peasant’s homestead rights of use and the better maintenance of its interests was suggested. |
