环境法视野下的中国水权制度演变研究

古代中国水利灌溉发达,对于水资源的管理古已有之,其中就包含了一些水权制度的雏形。以环境法的视野来看,中国古代的水权制度特别是明代以后的水权制度,虽未明确提出水权的概念,但其所包含的用水户参与式管理等具体内容却具有与现代水权概念相同的内涵,对完善我国现代水权制度具有实践指导意义。
