森林案件涉案伐倒木材积惟一性的探讨

材积是盗伐、滥伐等森林案件定性和处罚的主要依据,要求具有惟一性。用马尾松、杉木和杨树的伐倒木资料,分别按不同的计算方法计算其材积,结果表明:在3种树种中,中央断面区分求积式(区分段段数为5以上)的材积都最接近实际材积,误差也都较小,可作为森林案件中涉及伐倒木材积的惟一认定结果。

Study on the Soleness of the Down Volume concerning Forest Cases

The volume of timber is the main basis for nature determination and punishment of the forest cases such as illegal logging and its result must be sole.The data of the down timber to Pinus Massoni- ana Lamb,Cunninghamia lanceloate(Lamb.)Hook.and Populus Canadensis Moench.are used to calcu- late their volumes in different formula respectively,the results obtained are as follows:the volumes of sectional measurement formula with mid-section(n>5)are nearly equal to the exact ones and the ap- propriate error is smaller.So the volume is suitable to be sole as one of forest cases in the state of down timber.
