| 摘 要： | 文章从精神损害的广义和狭义的概念出发，本着广义说的原则对精神损害赔偿的主体范围和客体范围等进行了阐述。我国已确立精神损害赔偿制度以及它的赔偿范围，但司法实践中还存在着很多问题，文章论述了对精神损害赔偿的估算原则。
