| 摘 要： | 任何一个法律文本都不可能是完美无缺的,法律解释在所难免。法律解释是法律应用于个案的中间环节,是法律与事实之间联系的桥梁。没有法律解释就不可能有法律适用。我国法律应明确法官的法律解释权,让法官在个案中诠释法律,公正司法。

| Abstract: | Any legal text may not be perfect,so legal interpretation is unavoidable.Legal explanation is the intermediate link of applying the law to the case and the bridge to connect law and fact.Without legal explanation,there is no legal application.Our law should clear judge's power of legal explanation,so that judge can interpret law in the case and make justice fair. |
