| 摘 要： | 我国自然保护区土地权属不清,划界不明,制约了自然保护区的有效保护,引发了自然保护区与区内及周边社区尖锐的矛盾冲突。随着物权法的颁布实施,现有制度对划入自然保护区的周边社区集体土地的所有者所造成的侵权行为日益突显,而其根本原因正是自然保护区土地权属不明晰。以云南省白马雪山国家级自然保护区内4个行政村50户村民为样本,进行抽样调查,从自然保护区对当地社区的经济、生态和社会影响等角度出发,分析阐述了自然保护区的土地权属与有效保护的关系,并提出了相应对策。
