基于村民委员会候选人产生方式的调查与分析

文章以L村和X村村民委员会换届选举中村委会候选人的产生方式为例,指出在村民委员会候选人确立方式上存在着行政权力与自治权之间的冲突,分析原因并提出解决路径,即在立法方面明确村民自治的内函与地位,行政部门应充分为村民自治创造空间,尝试无候选人选举等。

Investigation and Analysis of Villager Committee Candidate Generation Way

With generation way of villager committee candidate in L and X village as example,the conflict between administrative power and autonomy was pointed out,the causes and solving way were put forward,namely delimiting the connotation and role of villagers autonomy in legislation,creating space for villagers autonomy,trying election without candidates and so on.
