农村土地信托保护模式下的土地可转移发展权运做模式研究

土地信托保护是指以保护土地为目的,土地的所有者、使用者、所有权人、使用权人或收益权人,将土地委托给受托人,受托人对委托人交来的土地进行管理经营,处置的行为。目前我国土地资源紧缺,且因为农业收入的比较利益低下,现行农村土地保护机制的不完善以及不科学的经营方式,导致农村土地在数量急剧减少、质量上也都遭到了严重的破坏。农地抛荒、土地资源浪费和破坏严重。于是国家提出用信托的方式来保护土地。即成立土地信托组织,使那些不愿意种田的农民,将土地流转出来。以实现土地资源的保护和高效规模经营。本论文就是在这个课题的基础提出。目前土地发展权在世界各国主要是用来保护土地和限制土地由农用转向农用地。本文考虑在通过适当的方式赋予土地信托保护组织一定的土地发展权利,以激励其更好的保护土地。

The Comparatively Study on Development Rights of Land

Now, our country is very short of land resource. Further more many countris'land was seriously destroyed,both land's number and quality. Because agriculture income is much less than other industry, and the way of land's protection and management isn't perfect and scientific. Now state put forward protect land with the way of land trust. That is transfer the farms'land who don't want to grow to some organizes, this organizes are set up with the way of trust. And the purpose of building this organize is to protect land. This paper is brought forward at this point. Now many countris' development rights of land is used to protect land, to restrict transferring farmland to land with other use. This paper consider granting organizes of land trust some development rights.It hope that this can prompt they protect land much better.
