论保障乡村振兴的涉农法律体系架构

乡村振兴是建设农业强国的必由之路。在法治语境中,乡村振兴离不开多领域涉农法律部门所构成的法律体系的保障。相应法律体系的构建应以宪法为统帅,以产业振兴法律部门、人才振兴法律部门、文化振兴法律部门、生态振兴法律部门和组织振兴法律部门为支撑,五个法律部门承担相应的法律保障和调整功能,针对部分法律部门或者法律文件不够健全的立法现状,应当加强国家立法或者通过行政法规、地方性法规等下位法律文件的制定,完善涉农法律体系,确保乡村振兴的专门性、系统性法律保障。

On Constructing the Agriculture-related Legal System for Ensuring Rural Revitalization

Rural revitalization is the path we must take to build up China''s strength in agriculture. In the context of the rule of law, rural revitalization cannot be realized without the protection of the legal system which is composed of agricultural legal departments in many fields. The construction of the corresponding legal system should be guided by the Constitution, supported by industrial, talent, cultural, ecological and organizational departments, which undertake corresponding function of legal protection and adjustment. In view of the current imperfect legislative situation in some legal departments or legal documents, we should strengthen national legislation or formulate administrative regulations, local regulations and other legal documents, and improve the legal system related to agriculture, so as to ensure the specialized and systematic legal protection in rural revitalization.
