合作社合作机制完善的法律对策

合作制是合作社作为民事主体存在的本质属性和根本特征,合作机制的欠缺无法体现合作制的优越性,无法实现弱者的联合,是制约合作事业健康发展的根本问题。针对中国目前合作社异化、合作机制欠缺的现状,将现有的法律制度及某些法律规范对合作机制的影响进行分析和研究,将合作机制的欠缺与法律制度的建设结合起来,从立法体系、登记制度、内部治理规范、成员法律制度、政府干预等方面提出纠偏和整治的对策和办法,以保障完善的合作机制的建立。

Legal Countermeasures on Perfecting Cooperation Mechanism of Cooperatives

Cooperation is the essential attribute and basic characteristics of cooperatives as a civil subject.The lack of cooperation mechanism can reflect the superiority of cooperation and is unable to achieve the combination.This is the fundamental problems to restrict the healthy development of business cooperation.According to the lack of cooperation mechanism in China,the authors tries to analysis the influence of existing legal system and some legal norms on cooperation mechanism and find legal system of promoting cooperation mechanism originating and perfect through combining with the lack of cooperation mechanism and legal system construction.The authors put forward the countermeasures and measures of rectification and renovation in order to ensure the perfect cooperation mechanism from the legislation system,registration system,internal management standard,members of the legal system,government intervention,etc.
