| 摘 要： | 专业人员的职业责任也可以发生在第三人与提供服务的专业人员之间。各国对专业人员第三人责任性质的认定主要有英美法系的侵权责任说、德国民法上的合同责任说和法国学者所主张的第三种责任说。我国应将专业人员对第三人的责任界定为侵权责任,并应在制订相关法律时对这一制度作出具体规定。
