| 摘 要： | 自20世纪60年代以来,随着西方经济分析法学的兴起,法律程序中的经济效率问题逐渐受到了各国学者的重视。诉讼程序简易化和简易程序多样化已成为刑事诉讼程序立法和发展的基本趋势。我国现行刑事诉讼法所确立的刑事简易程序存在适用范围狭窄、形式单一、对当事人主体地位尊重不足等多方面的问题,应在认真总结我国刑事诉讼立法和司法改革经验与教训的基础上,充分借鉴世界各国的成功经验,对其进行包括程序本身设计和配套制度建立在内的全方位完善。
