| 摘 要： | 农民合作经济组织作为农民以互利互助为基础自愿联合起来的,为其成员提供生产经营服务的合作经济组织,其基本属性内在地决定了其独立的市场主体地位.农民合作经济组织不仅具备法人资格要件以及企业法律形态构成要素,而且在责任形式等方面均不同于个人独资企业、合伙企业、公司等传统企业法律形态,因而是一种具有独立企业法律形态的特殊的企业法人.

| Abstract: | The farmer cooperative economic organization is an association of farmers united voluntarily to provide the services of production and management for its member,which is based on the idea of mutual benefit.Its intrinsic character has decided its independent status as market entity.The farmer cooperative economic organization not only has the personality of legal person and legal form of enterprise,but also differs from traditional legal form of enterprise such as enterprise of sole proprietorship,enterprise of partnership and company.It is a special enterprise legal person which has independent legal form of enterprise. |
