| 摘 要： | 采用文献综述法和资料分析法分析了我国土地征收现状凸显的问题,指出修改现行滞后的《土地管理法》和《土地征用》的必要性,合理界定公共利益的范围,完善拆迁程序,尤其是要按照《物权法》征收征用的相关规定,对被征收人依法进行充分的补偿和合理安置,切实维护被征收人的合法权益,真正使广大失地农民共享改革发展成果。

| Abstract: | By using the method of literature review and material analysis,problems in land expropriation of China were analyzed,and it pointed the necessity of modifying the current lagging "Land Management Law" and "Land Acquisition",defined the scope of public interests reasonably,perfected the demolition process,especially carry out adequate compensation and reasonable settlement for land-lost farmers according with the relevant provisions of expropriation and requisition in "Property Law",and earnestly safeguard the legitimate rights and interests of land-lost farmers,and make them share the achievements of reform and development. |
