摘    要:食品的制假、掺毒和欺诈等源于资本追求超额利润的天性。我国当前的食品安全问题主要在于公共管理的缺失,法律的约束力减弱,以及政府职能部门监管的错位。因此,公共管理回归是保证食品安全的关键,核心是运用法律对违法生产者实行惩罚性赔偿,明确政府职能部门职责,维护食品市场的公平和正义。

Abstract:This paper believes that the nature of capital seeking excess profit is the root of food adulterated,or added poisonous or deleterious(harmful)substance,and adulterating in raw materials and sold under the name of another food or imitation(a behavior of tricking). So,the food safety,per se,must be based on the force of law and public administration. But now in China,the public administration have been failing in his duty,and the constrained force of law have been weakened. Public administration returns to his place is critical for food safety. Persons or firms responsible for violations should be prosecuted and be awarded punitive damages,and/or be imprisoned.
