| 摘 要： | 我国刑法虽确立了自首制度,但在关于自首的本质问题上却存在着诸多争议。交易性是自首的本质。自首交易性的构成要素包括自首交易的主体(国家、犯罪者)、自首交易的筹码(刑罚权、"犯罪案件信息"利益等)。

| Abstract: | Although China's criminal law system established surrendered,but turned himself in at about the nature of the problem,there are many on the dispute.Transaction is the essence of surrender.Surrender of the constituent elements of the transaction including the surrender of the principal transactions(country,the offender),who surrendered a bargaining chip in the transaction(the right of the penalty,"information crimes" benefits,etc.). |
