大学毕业生就业中的法律问题探析

在大学生就业求职过程中,其权益受到侵犯的事件屡有发生,虽然国家和各级政府出台了一系列政策法规,但与之配套的法律和政策体系并不完善,主要表现在立法层次和法律效力低、权限划分不清和政策匹配性差、区域发展差异大和地方保护严重等方面。在就业过程中,大学生普遍存在法律知识淡薄、合同意识淡薄、维权意识淡薄、法制观念淡薄等问题。同时,用人单位也时常存在歧视大学生求职、拒绝与大学毕业生签订劳动合同、利用＂试用期＂侵害大学毕业生合法权益等违反法律法规的现象。因此,为保证大学生在就业过程的合法权益,政府应加强宏观调控和政策引导,大学生和用人单位应不断增强法制观念,共同努力培育和规范大学生就业市场。

The analysis and exploration of legal issues for college students in job hunting

Students＇ rights are violated frequently in the course of job-hunting.Although the state and governments at all levels issued a series of policies and regulations,the supporting laws and policies system is not perfect.It＇s mainly manifested in the following respects： the level of legislation and legal effect is low,with unclearly divided authority and policy matching being poor,with great difference in regional development and serious local protection.It＇s very common that college students is weak in knowledge of the law,contract consciousness,rights protection consciousness.At the same time,employers have job discrimination,refuse to sign labor contracts with university graduates,using the ＂probationary period＂ to aggrieve university graduates＇ legitimate rights and other phenomenon that against laws and regulations.To ensure the students legitimate rights in the employment process,there is the need for the government to strengthen macro-control and policy guidance and students and employers should continue to enhance their legal awareness.We must strive to foster and regulate the employment market,construct a harmonious employment system.
