摘    要:用人单位单方解除劳动合同方面存在一些问题,如用人单位不依法与劳动者签订劳动合同;劳动合同大多采用格式条款且权利义务的约定不明确;用人单位违法解除劳动合同等.规范用人单位依法单方解除劳动合同应采取如下措施:提高用人单位和普通劳动者的法律意识;依法明确双方各自的权利与义务;采取政府干预的方式,对用人单位制定强制性标准;加强执法监督,杜绝违法单方解除劳动合同的现象.

Abstract:There exist some problems in work units getting rid of labor contract unilaterally,for instance: work units sign labor contract with labors illegally,labor contracts are mostly adopted by format terms,rights and obligations are ambiguous,work units terminate labor contract illegally.The essential measures should be taken as follows: to raise law consciousness of work units and common workers,to definitude two sides with both rights and obligations by law,to adopt the way of the government intervention and to establish compelling criterions as to work units,to strengthen the law supervision and to put an end to the phenomenon of work units'terminating labor contract unilaterally.
