| 摘 要： | 农业转基因植物安全的法律监管涵盖研究与试验、生产与加工、经营与销售、进口与出口等方面。作物品种审定是农业转基因植物应用过程中的一项重要监管手段，属于一种行政许可。对农业转基因植物的法律保护主要包括遗传资源保护、植物新品种保护和培育方法专利保护，农业转基因植物中的基因可以申请专利保护。

| Abstract: | Legal regulation of agricultural transgenic plants safety covers all fields of research and test, production and process, management and sale, importation and export. As a important regulatory means in the application of transgenic plants, variety certification belongs to administrative licence. Legal protection of agricultural transgenic plants mainly includes genetic resources protection, new plant variety protection and patent protection of breeding method. The genes of agricultural transgenic plants can be applied for patent protection. |
