| 摘 要： | 不同行政强制执行模式的选择对于实现行政管理目标和保护行政相对人的合法权益具有不同的法律意义。笔者在评价我国现行的司法主导型模式优劣的基础上，提出重建一种“以行政机关自行强制执行为原则，以申请人民法院强制执行为例外”的行政主导型的混合模式。

| Abstract: | Different choice to the Model of the Administrative Imperative Implementation in China has different lawful sense to realise the goal of administration and protect the legal rights and interests of private party in the administrative process. The present author, based on appraising present model that judiciary is dominant, puts forward a mingled model that administration is dominant. And it indicates that it is in the principle of that administrative ogran that takes initiative to implement, to allow applying for imperative implementation of People'' s Court. |
