农村纠纷的社会学思考——基于L村1起遗产纠纷事件的剖析

通过对贵州黔东南地区的L村一起遗产纠纷事件进行剖析,运用社会学、法学等专业视野对其进行分析和思考。研究认为:高度关注农村纠纷或冲突在现实中是怎样产生、怎样解决、又会引发产生怎样的后续社会效果;要警惕村民自治和乡规民约对个别村民成员切身权益的剥夺,应当积极采用政府公权力鼓励弱势群体的抗争意识,及时救助和保护他们的合法权益;注意因势利导,适时推进民主法治进程,为构建社会主义核心价值体系作出不懈努力。

Sociological Contemplation on the Dispute in Rural Areas

Based on a case study on inheritance dispute in L village,the analysis and reflection are given in a professional view of sociology and law,the results indicates that descry the course,the background of the dispute and preview the further results after the dispute be settled then;vigilantly having the awareness that the informal social control system may seriously rob some poor people’s rights by law;and the advancing process of justice system in the rural area should be pushed and participated by the government as well as all the social members in the proper time and using the proper social events,making unremitting efforts to construct a core socialist value system.
