中国农村宅基地使用权流转的正当性辨析与立法构想

中国现行法律法规及相关政策严格限制农村宅基地使用权的流转,与市场经济条件下农村宅基地使用权流转的现实需求不符。允许农村宅基地使用权的流转与耕地保护并不矛盾,而农村宅基地使用权的生存保障功能也应被社会保障体系所替代。中国农村宅基地使用权流转的制度立法改革要有步骤地进行,改革初期宅基地使用权可以先允许有限制的流转,等待配套制度建设成熟后再推行自由流转。
