摘    要:基于对林权的物权化改造,将林权界定为森林资源承包经营权,并以林权抵押特征分析为切入点,进一步厘定林权抵押的概念。在此基础上,从重庆林权抵押立法现状出发,探讨其存在的局限性,并提出了完善林权抵押制度的建议:制定全市林权抵押融资专项立法、抵押物范围的拓宽、抵押权人主体扩大、抵押限制制度的完善、抵押物收回与抵押权人的保护。
