| 摘 要： | 巨额财产来源不明罪是针对国家工作人员的,作为国家工作人员有对自己财产的说明义务。正是由于对说明义务缺乏理解,才导致了对这个罪名本身是否是有罪推定以及举证责任分配等问题的争论。
